I-751 Removal of Conditions Interview Will No Longer be Waived by USCIS
The new I-751 Removal of Conditions interview requirements are going to change the green card process for spouses of U.S. citizens for at least as long as the Trump administration is around. We made a video about it.
The new I-751 Removal of Conditions interview requirements are going to change the green card process for spouses of U.S. citizens for at least as long as the Trump administration is around.
In this video, I tell you what I confirmed about the I-751 Petition to Remove Conditions of Residence and the new requirements when I visited the USCIS for a marriage fraud interview with a client just this week. Specifically, USCIS is going to be phasing out the use of the interview waiver for I-751 petitioners going forward and USCIS officers are already now starting to warn people during the CR-1/CR-6 interview.
Until now we have talked about the need to show proof of a bonafide marriage at the interview stage for the I-130/I-485, but going forward we are also going to have to start talking about the bonafide marriage in the bridge years between the marriage fraud interview for CR-1/CR-6 status and the I-751 interview to become an IR-1/IR-6. In essence, the permanent residency process has now gotten a bit more complicated for USC/Foreign national couples.
What I-751 Petition Changes May Mean for You
What this means for you, as I cover in this I-751 video, is that the need to document the marriage AFTER the initial marriage fraud interview is much higher than it was. Interview waivers will rarely if ever be given under the Trump administration going forward.
This also means that you will need to understand and keep track of what you said and turned in for your initial CR-1/CR-6 interview.
Will it Really be Like This?
If the administration changes in 2020 to one that is more friendly towards immigrants, then yes. But through the end of the Trump era, my guess would be that this change is going to stay in place. So get ready for the I-751 process to become more demanding. Still – take heart, you can do this, just like you successfully did the green card process.

Quick question – we will hopefully have a joint interview for i-751 and also naturalization soon. I (US citizen) will likely be away on a trip. Is that going to be a problem? Is it okay for my husband (applicant) to go by himself to the interview? Thanks!
Damjan says
No! Kids are not generally called for interviews when under 14.
Damjan says
So no need for you to be there for naturalization, but for the I-751 the answer is “maybe”. The good news is, you may not fall into the I-751 category if it is coming up now. Email us and we can get into more detail (we offer free 15 minute consults, which might be the easiest way to get this question fully answered!)

My husbands temp green card expired two weeks ago. Will there be any issues in submitting a late i 751?

Joint I751 interview was done and it’s over 6months no decision yet. We were not separated during the interview. Asked about my background and was given a white paper stating i751 case held for review.
